What's the Difference Between the Bail Bond Amount and the Premium?

Are you applying for a bail bond so you or a loved one can get released from jail? If so, it is important that you understand the difference between the bail bond amount and the bond premium.

  • The bail bond amount refers to the total amount of bail, or basically the total amount of money that the bail bondsman or agency agrees to pay on your behalf if you do not show for your court date. Depending on the specific case, this may be thousands or even millions of dollars.
  • The bail bond premium is the nonrefundable fee that the bail bonds agency charges you to post a bond (or the promise to pay) on your behalf. The fee is calculated by taking a certain percentage of the bail total. Bail bond fees usually range from 10% to 20%, depending on the agency.

Florida law (under the 2013 Florida States §624.4094) mandates that bail bond premiums cannot be less than 6.5% of the total bail bond amount posted by the agent or agency. It should be noted that in addition to the premium, the bail bonds agency may also collect fees for other costs or money that is being used as collateral.
