Orlando Man Sues Officer after Phone Was Seized & He was Arrested

An Orlando officer is being sued for violating the rights of a man who had his phone seized for recording an arrest outside a downtown bar. The man was then arrested for "non-violently" resisting officers. The young man was arrested and jailed for 15 hours for his actions before he was released from the Orange County Jail. No charges were filed and the department eventually returned his phone three weeks later–with the recorded arrest still saved.
The arresting officer claimed that the young man recording the arrest refused to hand over his phone and shoved the officer. The video clearly shows the officer abruptly snatch the phone away from him, without any type of resistance. The officer also claims that he did not take the man's phone away until he had handcuffed him and placed him in the back of a squad car for resisting arrest.
Fighting For His Rights
The man is now suing the officer who confiscated his phone and then arrested him for videoing police activity. He claims that the police officer violated his 1st, 4th and 14th amendment rights and that he was a victim of false arrest and imprisonment. The suit was filed in U.S. District Court in Orlando and has no further developments.
