Using Your Own Property to Secure Bail

A bail bond is provided by a bail bondsman to allow an accused defendant to be released prior to his or her trial. The purpose of a bail bond is to ensure that the defendant will appear in court at the scheduled time. Before the posting of a bail bond, either the defendant or a co-signer must guarantee that they will pay the full amount of bail if the defendant fails to appear in court. This can be paid by handing over the deed or title to certain property that is valuable enough to cover the bond.

Once the defendant's case is concluded, the bail bond is exonerated or otherwise released. However, if the defendant fails to appear in court and "skips bail," the bond money is forfeited unless the defendant is apprehended and returned to custody. The court may order the bond money forfeited upon the defendant's failure to appear and comply with the conditions of the bond. If the defendant is ultimately located and arrested by the bail agent, then the cosigner is held responsible for all expenses incurred by the bail agent while looking for the defendant.

There are different types of bonds which fall into the categories of secured and unsecured bonds. In some cases a defendant may be released "on his own recognizance," but in most bond cases it will involve either a cash, property, or a surety bond. While cash bonds, generally referred to as "bail" involve the payment of cash to the court, property bonds offer title to the defendant's own property, which is forfeited in the event of noncompliance by the defendant. With a surety bond a third party agrees to be responsible for the debt or obligation of the defendant.
